town of bennington zoning board of adjustment minutes 1 veterans memorial drive, bennington, vt 05201 JUly 12, 2000 @ 7:30 p.m. Present: Ron Alderman, Gale Wisher, Richard Owens, Bill Congdon, Kevin Goodhue, John Redding, Melissa Perrott, Edith Prandini, and Bill Barney. Also present: Zoning Administrator Daniel Monks, Julie McCauley, Tom Lyons, Mike von Ouhl, and Robyn Baker. Ms. Wisher called the meeting to order at 7:30 p.m. 1. Minutes of June 28, 2000. Mr. Goodhue moved to accept the minutes of June 28, 2000 as presented. Mr. Owens seconded the motion. The motion passed with eight in favor. Ms. Prandini abstained, as she was not present. 2. Reading of witness' oath. Ms. Wisher read the witness oath: "I solemnly swear and affirm under the pains and penalties of perjury that the statement I make, the testimony I give, and other evidence I submit to the Zoning Board of Adjustment at the Board's public hearing held on this date shall be true and correct to the best of my knowledge and belief." 3. Tom Lyons and William Morse, 327 Northside Drive, seeking conditional use approval for a new car dealership at the above address, a CI District. Sections of the Bylaw applicable are: 3.4, 6.0, 6.1, 8.5. Mr. Lyons presented the project to the Board. He explained that he owns Bennington Subaru, and would like to relocate to the former Brown Radiator facility. Mr. Alderman asked if there would be additional construction, and Mr. Lyons said that there would not. He noted that this is a permitted conditional use in that area. Mr. Lyons indicated the area on the site plan that he would be using. Mr. Monks noted that the Planning Commission forwarded no adverse comments. Mr. Barney asked and Mr. Lyons noted that the new cars would be on the bridge side, and the other side would be service parking and repair, and perhaps used cars. Mr. Barney asked if they had placed stipulations on a previous applicant at that site, and the Board noted that it was for a different use. Mr. Barney asked if the applicant would renovate the building, and he indicated that there would be extensive renovations. Mr. Lyons felt that the whole front would be changed as you come down 67A. There would also be blacktopping of the front and sides, and the property will look much nicer. Ms. Wisher asked how many cars are serviced, and Mr. Lyons noted that there are probably 15-20 per day. Ms. Prandini moved to grant conditional use approval as requested. Mr. Alderman seconded. The motion passed unanimously. 4. Bennington Housing Authority, Julie McCauley, Willowbrook, 10 Willowbrook Road, seeking conditional use approval for 24 student day care facility at the Willowbrook Housing Development's Community Building located in an MR District. Sections of the Bylaw applicable are 3.4, 4.3, 8.5. Julie McCauley presented the project to the Board. She indicated the location of the center on the site plan. She explained that they have 18 students enrolled. The groups break into small groups. There is not a lot of traffic. Red Cross drops off some children. She explained that they are using an existing building. Ms. Wisher asked if this would be year round, and Ms. McCauley noted that it is just a summer program. The children are aged six to ten. They have not decided whether to continue next year. Ms. Wisher asked, and Mr. Monks felt that it would be appropriate to grant this as a continuous use. Mr. Barney asked if the students were from Willowbrook, and Ms. McCauley explained that it is open to the public, and they care from children from Willowbrook, Applegate, and the community. Mr. Barney asked if they have access to the playgrounds. Ms. Wisher asked about hours of operation, and Ms. McCauley noted 7:45 to 5:15 Monday through Friday. Ms. Prandini felt that they should restrict the program to summer, June 1 through September 1. Ms. McCauley was comfortable with the date restriction. Ms. Prandini moved to grant the conditional use approval for a 24-student day care facility with the hours of operation of 7:45 to 5:15 from June 1 to September 1. Mr. Owens seconded. The motion passed unanimously. 7. Other Business ¨ Findings of fact and minutes were passed around and signed. ¨ Mr. Monks read the warning for July 26, 2000.
