BENNINGTON SELECT BOARD MEETING BENNINGTON FIRE FACILITY 130 RIVER STREET BENNINGTON, VERMONT 05201 MONDAY, MARCH 12, 2012 MINUTES BOARD MEMBERS PRESENT: Matt Maroney-Vice-Chair; Jason Morrissey; John Zink; Chris Oldham; Justin Corcoran and Sharyn Brush. ALSO PRESENT: Stuart Hurd-Town Manager; Dan Monks-Planning Director; Jim Carroll; Mike Bethel; Barry Horst; Neal Goswami-Bennington Banner and Nancy Lively-Recording Secretary At 5:32 P.M., Matt Maroney called the meeting to order. 1.MINUTES - FEBRUARY 27, 2012 John Zink moved and Jason Morrissey seconded to approve the Minutes of February 27, 2012 as submitted. The motion carried unanimously. 2.WARRANTS The warrants were circulated for signatures after Mr. Hurd answered questions on the gatekeeper at the transfer station, variable frequency drives, the $500 deductible insurance claims, and gravel and sand screws. 3. PLANNING COMMISSION PRELIMINARY ON CI DESIGNATION Mr. Monks shared the following information with the Board: * It has been approximately 10 years since we've had a CI designation and it was similar to the Commercial designation that we have now. * Development in the CI areas was 100% commercial. * A Planned Commercial District does not include industrial uses but will be expanded to include Manufacturing and Research and Development uses. * We cannot legally "spot zone" any one particular property. We need to apply "uniformed characteristics to like properties". * In a CI designation, we could try to get creative and designate a certain percentage to commercial and a certain percentage to industrial, however, this is not the normal practice and would be difficult to do legally. 4.2012 LIQUOR AND TOBACCO LICENSE APPLICATIONS The following 2012 Liquor License Renewal Applications were circulated for signatures: First Class Renewals - 1.Allegro Ristorante 2.Pizza Hut 3.Ramunto's Pizza Second Class Renewals - 1.Bennington Beverage Outlet 2.Cumberland Farms #8006 3.Stewarts Shops #195 4.Twin State Food Marts, Inc. (f/k/a Fleming Oil Co.) The following 2012 Tobacco License Renewal Applications were circulated for signatures. 1.Bennington Beverage Outlet 2.Cumberland Farms #8006 3.Stewarts Shops #195 4.Twin State Food Marts, Inc. (f/k/a Fleming Oil Co.) 6.MANAGER'S REPORT Mr. Hurd reported that we could save as much as $147,700 in winter salt and sand costs as a result of our mild winter. On the flip side, we also have seen higher fuel prices than expected, however, any unexpended portion of this will be rolled over into the fund balance for FY13. Because of the weather we will also be able to get an early start on the Beech Street project that we weren't able to get to last year. 5.OTHER BUSINESS None. 9.EXECUTIVE SESSION A.CONTRACTS B.LEGAL ISSUES At 5:50 P.M., John Zink moved and Chris Oldham seconded to go into Executive Session to discuss Contracts and Legal Issues.
