Town of Bennington Select Board & Planning Commission Monday, November 15, 2004 7:00 p.m. Town Office Building 205 South Street, Bennington, Vermont 05201 MINUTESPresent: Barry Horst, Sharyn Brush, Lodie Colvin, Jim Gulley, Chris Oldham, Charles Copp, Joe Krawczyk, Mike Lochner, Mike McDonough, Scott Creedy, Bob Burgess Also Present Stuart Hurd, Town Manager, Dan Monks - Zoning Administrator, Laura Raskin - Bennington Banner Meeting was called to order at 7:00 p.m. Proposed Large Scale Retail Bylaw - Discussion The Planning Commission and Select Board members discussed, at length, the proposed Large Scale Retail Bylaw submitted to the Select Board by the Planning Commission. Several concerns were raised by Select Board members, including concerns that the retail size cap should apply to the CB District and that the "trigger" for the Community Impact Study was too low. At least one member did not support the use of a Community Impact Study. Some members questioned the specific criteria used in the Community Impact Study. By consensus, the Select Board modified the Large Scale Retail Bylaw proposed by the Planning Commission by: a) Imposing a 75,000 sq.ft. cap on retail stores in the CB District; and b) Raising the trigger for a Community Impact Study from 20,000 sq.ft. to 30,000 sq.ft. (See Attached Proposed Large Scale Retail Bylaw marked to show changes to the Planning Commission's proposal). By Consensus the Select Board resolved to conduct a public hearing on December 13, 2004 at 7:15 p.m. at the Bennington Fire Facility for the purpose of considering the proposed Large Scale Retail Bylaw as modified by the Select Board, and the Select Board resolved by consensus that all public notices required by law for such public hearing be posted, published and/or mailed.
