Town of Bennington Planning Commission
                            MINUTES
                   July 23, 2001   6:00 p.m.
                      Town Office Building
          205 South Street, Bennington, Vermont 05201
                    Members Present:    Barry Horst - Chair, Bob Burgess - Clerk, 
               Michael McDonough, Sharon Yorke
                    Also Present:       Dan Monks, Zoning Administrator
The meeting was called to order at 6:00 p.m.
Findings Re: 139 Shields Drive -
     The Zoning Administrator read the attached Findings of Planning Commission.  The Findings are required as part of proposed Vermont Economic Development Authority financing for the purchase of 139 Shields Drive by Vermont Composites.
     Bob Burgess moved that the Findings be approved.
     Mike McDonough seconded the motion.
     The motion passed unanimously.
Zoning Bylaw Revision Project -
     The Planning Commission by consensus scheduled the initial Public Forum for the  Bylaw Revision Project for 7:00 p.m. on August 27, 2001 and September 6, 2001 at the Bennington Fire Facility.
Other Business  -
     Bob Burgess expressed concern about the appointment of the Town of Bennington Zoning Administrator.  He noted an apparent conflict between State Statute that authorizes the Planning Commission to appoint the Zoning Administrator and the Town of Bennington Charter that authorizes the Town Manager to hire and fire all Town employees and officers that are not elected or appointed by the Select Board.  By consensus the Planning Commission agreed that the Zoning Administrator should seek an opinion from the Secretary of State regarding the matter and report back to the Planning Commission.
     By consensus, the Planning commission agreed that the next meeting would be August 8th, 2001 at 5:00 p.m. in the Town Office Conference Room.
 
The meeting was adjourned at approximately 7:00 p.m.
