DEVELOPMENT REVIEW BOARD August 18, 2009 7:00 PM BENNINGTON FIRE FACILITY 126 RIVER STREET, BENNINGTON, VT MINUTES BOARD MEMBERS PRESENT: Charles Copp, Chair; Barry Hörst, Vice Chair, Al Ray, Dan Malmborg and Ron Alderman, Bill Barney, and Milt Surdam. NOT PRESENT: Ryan Morse was excused from the meeting as he had a conflict of interest in the matter for consideration. Michael von Ouhl was also not present. OTHERS PRESENT: Lindy Lynch, Tom Dailey, Joann Erenhouse, Daniel Monks, Zoning Administrator; and Robyn Baker, Recording Secretary. Copp called the meeting to order at 7:00 PM. 1. Minutes of August 4, 2009. Hörst moved and Malmborg seconded approval of the minutes of August 4, 2009 as amended. The motion passed unanimously. 2. Interested Persons - Appeal Rights - Reading of witness' oath Monks read the oath. 3. Disclosure of Ex parte Communications and Conflicts of Interest Milt Surdam recused himself from the matter. 4. Alternates - Voting Assignments All members present are voting on this matter. 5. Bennington Area Chamber of Commerce, West Road, the applicant is seeking approval for the Garlic Festival to be located at Camelot Village on West Road. Lindy Lynch reported that they are continuing the model that worked last year. In addition to garbage pickup, there will be recycling buckets at each garbage can. The shuttle, garbage, port-a-potties, parking, etc., remains the same as last year. They are hoping for a continuous/blanket permit so that they don't have to return every year. Copp reported that would be discussed during deliberations. Lynch reported that there were approximately 7,000 attendees last year. They had bands last year the whole time from 11 AM through 4 PM. Copp asked about section 9 on the parking, they asked for a fence last year, and Lynch reported that they would use caution tape there again this year. They have enough parking volunteers to monitor the area. Copp asked for a graphic scale on the drawing in case the drawing is reduced. Malmborg asked about the legal notice mentioned in the certificate of service, and Monks noted that it did get sent out appropriately. Tom Dailey addressed the Board. He asked if a blanket permit was possible so that they don't need to come back and go through the formal application every year. Monks reported that they would need the permission from all the property owners to be indefinite. That matter will be discussed during deliberative session. Monks reported that there were no unanswered questions from last year. Alderman moved to grant preliminary approval as requested. Ray seconded. The motion passed unanimously. 9. Other Business As there was no further business, Hörst moved to adjourn. Von Ouhl seconded. The motion passed unanimously. The meeting was adjourned at 7:13 PM.
