BENNINGTON DEVELOPMENT REVIEW BOARD MEETING BENNINGTON FIRE FACILITY 130 RIVER STREET BENNINGTON, VERMONT 05201 TUESDAY, MAY 19, 2009 MINUTES BOARD MEMBERS PRESENT: Charles Copp-Chair; Barry Horst-Vice-Chair; Al Ray; Bill Barney; Michael von Ouhl and Ron Alderman. ALSO PRESENT: Dan Monks-Zoning Administrator; Thomas Morris; Mark Bannon and Nancy Lively-Recording Secretary. At 7:00 P.M., Charles Copp called the meeting to order. 1.MINUTES OF MAY 5, 2009 Michael von Ouhl moved and Barry Horst seconded to approve the Minutes of May 5, 2009 as submitted. The motion carried unanimously. 2. INTEREST PERSONS - APPEAL RIGHTS - READING OF WITNESS' OATH Mr. Monks read the oath. 3. DISCLOSURE OF EX PARTE COMMUNICATIONS AND CONFLICTS OF INTEREST None. 4. ALTERNATES - VOTING ASSIGNMENTS Not present. 5. BENNINGTON ELDER LIVING, LLC, THE VILLAGE AT FILLMORE POND, 300 VILLAGE LANE Mr. Morris noted that the following requests from the last meeting have been addressed: * A graphic scale should be added to all drawings. * The plans should be revised to reflect the existing pathways on the site. * The plans should be revised to reflect that the property is located in the RC Zoning District. * A simulation of the view of the proposed addition from Route 9 should be submitted. * More detailed information regarding storm water should be submitted. * The specific location of the re-located fire hydrant must be identified on the plan. Mr. Bannon added that a storm water permit had to be obtained. The existing swale will remain with guttered roof discharge into the existing system to drain by cottages, and ultimately, flow into the pond and wetlands. This is a storm line swale and does require erosion control because the project is more than one acre. Barry Horst moved and Al Ray seconded to close the hearing for the Bennington Elder Living, LLC, The Village at Fillmore Pond, 300 Village Lane and go into Deliberative Session. The motion carried unanimously. 6. OTHER BUSINESS None. At 7:10 P.M., Bill Barney moved and Barry Horst seconded the adjournment of the meeting. The motion carried unanimously.
