DEVELOPMENT REVIEW BOARD April 1, 2008 7:00 PM BENNINGTON FIRE FACILITY 126 RIVER STREET, BENNINGTON, VT MINUTES BOARD MEMBERS PRESENT: Charles Copp, Chair; Barry Hörst, Vice Chair; Al Ray, Ryan Morse, Bill Barney, and Eugene Rowley. NOT PRESENT: Ron Alderman and Michael von Ouhl. OTHERS PRESENT: Dan Monks, Zoning Administrator; Joe Hall, Jim Secor, Jason Dolmetsch, and Robyn Baker, Recording Secretary. Copp called the meeting to order at 7:00 PM. 1. Minutes of March 18, 2008. Hörst moved and Ray seconded approval of the minutes of March 18, 2008 as presented. The motion carried. . 2. Interested Persons - Appeal Rights - Reading of witness' oath Monks read the oath. 3. Disclosure of Ex parte Communications and Conflicts of Interest None. 4. Alternates - Voting Assignments The regular Board members present were all voting. 5. B&F Real Estate, Stocklee Lane, the applicant is seeking an amendment to a previously approved Planned Residential Development off of Stocklee Lane. The applicant has requested a continuance to the April 15, 2008 meeting. Hörst moved and Morse seconded approval of the continuance as requested. The motion passed unanimously. 6. Carole Thompson, 2920 Mt. Anthony Road, the applicant is seeking approval to demolish an historic structure on Mount Anthony Road. The applicant has requested a continuance to the April 15, 2008 meeting. Hörst moved and Morse seconded approval of the continuance as requested. The motion passed unanimously. 7. Jane Cole Realty, LLC, Chapel Road (just east of the alignment of the northern leg of Route 279), the applicant is seeking preliminary development plan approval for an approximately 10 acre gravel pit off of Chapel Road. Monks reported that this is a preliminary review. Secor explained that the pit will be utilized for the new highway in three phases. The last phase will be complete in 2011, not 2015 as previously stated. This is an active pit developed by Willie Morse years ago. They hope to utilize it for the next phase of construction, but that depends on another contractor's phasing schedule. They are trying to accelerate that and might have to utilize a section of Chapel Road during the second phase. They will be posting bonds for the reclamation project, and a pavement payback for Chapel Road. They are open to permit conditions requiring bonds that are mutually acceptable to both the town and applicant. Morse asked about the starting time of 6:30 AM on Saturdays. Secor reported that they have notified area residents and not heard any comments. Ray noted that Phase 2 would have a 2 year duration. Secor explained that they are really looking for 2008-2009 with a slight overlap, which may be extended out. They cannot close the phase until it is vegetated. There is a six month overlap when each phase is open to allow grass to grow. The general notes will be revised for consistency. There will be two years in each phase with a slight overlap. There are two plans, reviewed by Dolmetsch, the storm water plan, C102, and the development plan, C101. One of the plans shows the phasing plan. The two plans won't agree. Ray asked about blasting, and Secor explained that there would not be any need for blasting as they have encountered no ledge. They are not looking for rock backfill. Barney asked if this would exhaust the pit, and Secor does not feel that it will. Barney asked Monks, and Monks explained that this permit has an expiration date. Act 250 will be in place for this project. This will exceed historical extraction. It is an active pit. Barney asked about ten yard trucks, and Secor noted that the client requested that. Secor noted that there is a severe erosion issue that will be fixed and stabilized. Morse asked if there would still be access once the Bypass is complete, and Secor noted the location of the quarry road. Copp asked about the entrance road which is in very bad shape. On C101 it is shown as 12 feet and on C102 it is shown as 24 feet. C102 is a construction entrance detail, and it does not agree with C101. Secor noted that it would be bigger than 12 feet, but less than 24, not paved, but 1-4 inch stone. The intention is to prevent and stabilize the road with the goal to attack any sediment leaving the site at both the exit from the mine area and the actual road itself. It will be a construction entrance which should knock whatever is on the tires off. They are trying to put in diversion structures to prevent runoff on the road. They will widen both turning radius, and extend the culvert. Pat Kinney will need to approve final construction entrance. Dolmetsch explained that SWPPP is Storm Water Pollution Prevention Plan. Ray asked about the 50 foot minimum on C102, and Dolmetsch noted that would be revised, there will be a 50 foot buffer from the edge of the stream. Since this is a temporary use, they are not worried about wildlife issues. Hörst moved to grant preliminary approval. Morse seconded. The motion passed unanimously. The applicant will make the required changes to the phasing schedule, and address the question about hours of operation on Saturdays. Joe Hall noted that he is happy to see the road improved, as he owns a wood lot adjacent to the site. He has no other problems with the gravel bed there. He explained that the road does provide access to some lots. His only access is through that bar. There will have to be some kind of security. Hall presently has a key. He can access this lot off Chapel Road further up and follow the power line, but it's not very good. There is no deeded right of way, but years ago, Willie Morse gave them permission to use the road. He found a pent road established in 1886 in the town road books. They have always been allowed to use this access. There will be a road left through there after the gravel road is removed. Once the state is through with the construction, they are hoping to use the pent road. 9. Other Business As there was no further business, Hörst moved to adjourn. Rowley seconded.
