DEVELOPMENT REVIEW BOARD MARCH 20, 2007 7:00 PM BENNINGTON FIRE FACILITY 126 RIVER STREET MINUTES BOARD MEMBERS PRESENT: Charles Copp, Chair; Barry Hörst, Vice Chair; Bill Barney; Michael von Ouhl, Richard Owens, Ron Alderman and Al Ray. ALTERNATE BOARD MEMBERS PRESENT: Gene Rowley. OTHERS PRESENT: Dan Monks, Zoning Administrator; Keith Martin; Sandy Renning; Charles & Lynn Keir; and Robyn Baker, Recording Secretary. Charles Copp called the meeting to order at 7:00 PM. 1. Minutes of March 6, 2007 Von Ouhl moved and Barney seconded approval of the minutes of March 6, 2007 as presented. The motion carried. Rowley and Alderman abstained as they were not present. 2. Interested Persons - Appeal Rights - Reading of witness' oath Monks read the appeal rights and witness oath. 3. Disclosure of Ex parte Communications and Conflicts of Interest Rowley recused himself from the Geannelis sign hearing. 4. Alternates - Voting Assignments None. 5. Written Decisions * Bennington Green Mountain LLC, Fillmore Street * Allegro associates, East Road Von Ouhl moved and Owens seconded a motion to authorize Copp to sign the written decisions on behalf of the Board. The motion passed unanimously. 6. Geannelis Food Service Inc., 520 Main Street, review of sign design. The ARP reviewed this matter. Hörst reported that the ARP recommends approval of the sign design. Monks reported that the HPC also reviewed the sign design with no adverse comments. Von Ouhl moved to approve the sign design as presented. Barney seconded. The motion passed unanimously. 7. Keith Martin, 735 Main Street, The applicant is seeking development plan approval for the demolition of the existing Pet Pantry building, the relocation of two non-conforming gas station pump island canopies and other site improvements. Monks reported that this is the second hearing. Keith Martin addressed the Board. Barney asked about the photos and Martin explained that both canopies would be the same, single column canopies, blue on white. Copp asked about the sidewalks and handicapped ramps, and Martin described them, and agreed to have them clearly depicted on the site plan. Sandy Renning, owner of the Safforde Inn across the street from the site, asked about hours of operation. Martin explained that they will remain the same, 6 AM to 10 PM, 7 days per week. Refueling will happen after hours. Barney asked and Martin explained that Champlain Oil offers a service that provides access during the night to certain emergency vehicles. It is a national, and similar to their previous one. Hörst moved to close the hearing to deliberative session. Rowley seconded. The motion passed unanimously. 8. Other Business None.
