OTHERS PRESENT: Dan Monks-Planning Administrator; Dave Naaktgeboren; Christopher Baudo; Mike Lynch; William Wright; Mark Beatty; and Recording Secretary, Christa LeBlanc 1. MINUTES OF JUNE 20, 2006: Barry Horst moved and Michael vonOuhl seconded to approve the Minutes of June 20, 2006 as written with the following change: Change line 18 to June 6, 2006. Change line 61 from the "Bennington Arts Guild" to "Kevin and Sandra Dunican, 2178 Walloomsac Road". Change line 76 from "14" to "10". Change line 92 from "15" to "11". The motion carried unanimously. 2. INTERESTED PERSONS - APPEAL RIGHTS & READING OF WITNESS OATH Dan Monks read the Appeal rights and Witness Oath. 3. DISCLOSURE OF EX PARTE COMMUNICATIONS AND CONFLICTS OF INTEREST None. 4. ALTERNATE VOTING ASSIGNMENTS All members voting. 5. WRITTEN FINDINGS: Ronnie Ouimet, 2601 West Road Tony Bolio, 702 North Branch Street The Board authorized the Chair to sign the above written findings. 6. KEVIN AND SANDRA DUNICAN, 2178 WALLOOMSAC ROAD Final subdivision plan review of three lot subdivision. Mr. Naaktgeboren stated that the applicant has received their water and sewer permit from the State of Vermont. Michael vonOuhl moved and Barry Horst seconded to close the hearing and discuss in Deliberative Session. The motion carried unanimously. 7. CARL CAPELLA, STOCKLEE LANE Sketch plan review of 100 dwelling unit Planned Residential Development. Christopher Baudo addressed the Board's concerns regarding the following: * Indicated the wetlands along Burgess Road * Reduced building sites from 57 to 50 * Sidewalks and pathway plans * Driveways * Bus shelter * Buffering for abutting neighbors Mike Lynch and William Wright felt that a 100' buffer would be more sufficient than the proposed 50' buffer. Mark Beatty commented that he would prefer fencing rather than the proposed buffer in order to keep people off his land. Albert Ray moved and Barry Horst seconded approval to close the hearing and discuss in Deliberative Session. The motion carried unanimously. 8. OTHER BUSINESS No other business. At 7:40 p.m. Michael vonOuhl moved and Richard Owens seconded to adjourn the meeting and go into open Deliberative Session. The motion carried unanimously.
