MINUTES
OCTOBER 4, 2005


BOARD MEMBERS PRESENT:  Michael Brady-Chair; Barry Horst-Vice Chairman; Albert Ray; Charles Copp; Michael vonOuhl; Bob Burgess; and Randy Maxon.

ALTERNATE BOARD MEMBERS PRESENT:  Richard Owens and Eugene Rowley

OTHERS PRESENT:  Dan Monks-Planning Administrator; Jason Dolmetsch; and Recording Secretary, Christa LeBlanc

1.  MINUTES OF SEPTEMBER 20, 2005:
	 Charles Copp moved and Michael vonOuhl seconded the approval of the Minutes of September 20, 2005 pending investigation of line 92.
			The motion carried unanimously.

2.  INTERESTED PERSONS -APPEAL RIGHTS & READING OF WITNESS OATH
	Dan Monks read the Appeal Rights and Witness Oath.

3.  DISCLOSURE OF EX PARTE COMMUNICATIONS AND CONFLICTS OF INTEREST
	None.

5.  ALTERNATE VOTING ASSIGNMENTS
	All members voting.

6.  ROBERT TATRO, 424 PARK STREET
	Review of development plan and design plan for new 30'X50' commercial building.  
Jason Dolmetsch stated the paved apron has been noted on the plan, a new 42" fence will be installed along the existing parking area and a silt fence will be installed to protect the swale.
	Charles Copp commented that the setback should be from the property line not the water line.  Mr. Dolmetsch will make this change.
	Bob Burgess moved and Eugene Rowley seconded to close the hearing and discuss in Deliberative Session.
		The motion carried unanimously.

7. BLS BENNINGTON, LC, WAL-MART STORES, INC., MONUMENT PLAZA, 210 NORTHSIDE DRIVE
	Delivery of Recess Memorandum to applicant and continuance of hearing.  Michael Brady gave brief overview of the Recess Memorandum.  
	It is the consensus of the Board to have the Chair sign the Recess Memorandum.
	Richard Owens moved and Barry Horst seconded approval for a continuance.
		The motion carried unanimously.
	
8.  OTHER BUSINESS
	No other business.

		
At 7:15 p.m. Eugene Rowley moved and Richard Owens seconded approval to adjourn the meeting and go into Deliberative Session.
The motion carried unanimously.
