DEVELOPMENT REVIEW BOARD BENNINGTON FIRE FACILITY, 3RD FLOOR 126 RIVER STREET BENNINGTON, VT 05201 MINUTES JANUARY 18, 2005 BOARD MEMBERS PRESENT: Michael Brady-Chair; Barry Horst-Vice Chair; Bill Barney; Charles Copp; Janet Thompson; Randy Maxon; and Bob Burgess. ALTERNATE BOARD MEMBERS PRESENT: Albert Ray and Andrew Anderson OTHERS PRESENT: Dan Monks - Planning Director; Dave Mance; Tim Taylor; and Frank Remillard. 1. MINUTES OF DECEMBER 21, 2004 Bob Burgess moved and Charles Copp seconded approval of the Minutes of December 21, 2004 as written. The motion carried unanimously. 2. READING OF THE WITNESS OATH: Dan Monks read the Witness Oath. 3. DISCLOSURE OF EX PARTE COMMUNICATIONS AND CONFLICTS OF INTEREST: None. 4. ALTERNATE VOTING MEMBERS: Albert Ray and Andrew Anderson present. 5. WRITTEN DECISION: Jerome Rental Enterprises, Inc., 1545 West Road. Dan Monks stated the continuation of the nonconforming use was approved. The Board authorized the Chair to sign the above written decision. 6. ARMORY PACIFIC LLC, BENMONT AVENUE (FORMER BENMONT MILL SITE) Preliminary review of three lot subdivision. Dave Mance stated the north end of the common roadway has been shifted and the entrance is now opposite to Tire Warehouse. This change will have no conflict with the open section of the stream that runs through parcel A. Dave also changed the potential connection on to Route 7 to a possible future road and has shown Veterans Memorial Drive on the map. There is also a five foot difference in elevation between the lower portion of Parcel A and Parcel B. Bob Burgess moved and Randy Maxon seconded to close the hearing and discuss in Deliberative Session. The motion carried unanimously. 7._TRACTOR SUPPLY COMPANY, 300 DEPOT STREET Review of a requested amendment to the previous development plan. The applicant is requesting that the height beside the store be increased to eight feet and twelve feet in the outside storage area. Andrew Anderson moved and Charles Copp seconded to approve the amendment that within the fenced in area, the maximum height limit is twelve feet, with the exception of the corners closest to the building shall remain at six feet, ten feet from the fence. In the trailer display area, the maximum is raised to eight feet with the stipulation that there be no stacking of trailers within that area. The motion carried unanimously. 8. SHARON STEMP, 1506 VAIL ROAD Request for continuance for a two lot subdivision. Andrew Anderson moved and Barry Horst seconded the request for continuance. The motion carried unanimously. 9. OTHER BUSINESS No other business. At 8:25 p.m. Andrew Anderson moved and Bob Burgess seconded to adjourn the meeting and go into Deliberative Session to discuss Armory Pacific LLC, Benmont Avenue, preliminary review of three lot subdivision.
